1. The contract stipulated between GORI GIOIELLI and the Customer must be considered concluded with the acceptance, even partial, of the order by GORI GIOIELLI. This acceptance is considered tacit, unless otherwise communicated in any way to the customer. By placing an order in the various ways provided, the customer declares to have read all the information provided to him during the purchase process, and fully accept the general conditions and payment transcribed below

2. If the customer is a consumer, once the online purchase procedure, will print or save an electronic copy and in any case keep these general conditions of sale, in accordance with the provisions of art. 3 and 4 of Legislative Decree 185/1999 on distance selling

3. Is excluded any right of the customer to damages or compensation, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and / or property, caused by the rejection, even partial, of an order Purchase mode

4. The Customer can purchase only the products present in the electronic catalogue of GORI GIOIELLI at the moment of the forwarding of the order and viewable online at the address (URL) www.gorigioielli.com, as described in the relative informative cards. 5. The correct receipt of the order is confirmed by GORI GIOIELLI through a response by e-mail, sent to the email address supplied by the customer. This confirmation message will contain Date and Time of execution of the order and a 'Customer Order Number', to be used in any further communication with GORI GIOIELLI. The message contains all the data entered by the customer who agrees to verify the correctness and communicate any corrections, according to the procedures described in this document

6. In case of non-acceptance of the order, GORI GIOIELLI guarantees timely communication to the Customer

7. Method of payment: Bank Transfer in advance. In case of payment by bank transfer in advance, the start of the procedure of order processing will take place only when the actual crediting of the amount due on the account of GORI GIOIELLI. The reason for the bank transfer must report

- the reference number of the order

- the date the order was placed

- name and surname of the holder of the order

8. Payment by credit card.

For the payment of the price of the products and the related shipping costs you can follow one of the methods indicated in the order form: Credit card: We accept the following credit cards VISA , MASTERCARD, AMERICAN EXPRESS, DINERS and prepaid cards of the Visa Electron circuit. In case of cancellation of the order, either by the customer or in case of non-acceptance of the contract by GORI GIOIELLI, GORI GIOIELLI will request the cancellation of the transaction and the transfer of the amount committed. The times of release depend exclusively on the banking system and can reach their foreseen expiry date (24° day from the date of authorisation). Once the cancellation of the transaction has been carried out, GORI GIOIELLI cannot in any case be held responsible for delays and/or damages caused by the banking system. In the case of payment by credit card, the financial information will be forwarded, via encrypted protocol, to the Payment Gateway Service of Consorzio Triveneto Spa which provides the relative remote electronic payment services, without third parties being able to access it in any way. This information, moreover, will never be used by GORI GIOIELLI if not to complete the procedures relating to the purchase and to issue refunds in case of any returns of products, following the exercise of your right of withdrawal, or if it is necessary to prevent or report to the police commission of fraud on www.gorigioielli.com

Delivery methods and costs

9.For each order placed, GORI GIOIELLI issues an invoice of the material shipped, sending it together with the package to the holder of the order, in accordance with art 14 D.P.R. 445/2000. For the emission of the invoice, the information given by the Customer at the moment of the order will be used. No change in the invoice will be possible after the issuance of the same

10. The delivery costs are communicated by GORI GIOIELLI at the moment of the order confirmation and are charged to the Customer. The payment of the goods by the Customer will be made using the method chosen at the moment of the order. Nothing more is due by the Customer compared to the total amount of the order shown at the end of the purchase procedure

11. No responsibility can be attributed to GORI GIOIELLI in case of delay in the execution of the order or in the delivery of what has been ordered

12. Unless explicitly indicated by our Customer Service, the delivery is intended at street level. At the moment of delivery of the goods by the courier, the Customer must check - that the number of packages delivered corresponds to that indicated in the accompanying invoice; - that the packaging is intact, undamaged, or wet or otherwise altered, including the sealing materials (eg adhesive tape, metal strapping etc. etc.). Any damage to the packaging and/or to the product or the mismatch in the number of packages or indications must be immediately contested by putting a WRITTEN RESERVE OF CONTROL on the courier's proof of delivery. Once signed the document of the courier, the customer can not make any objection about the external characteristics of the delivered goods. Any problems concerning the physical integrity, correspondence or completeness of the products received must be reported within 7 days of delivery, according to the procedures provided in this document

13. In case of failure to collect within 5 working days of the material in storage at the warehouses of the courier due to repeated inability to deliver to the address specified by the customer when ordering, the order will be automatically canceled by charging the additional costs of storage.

Right of withdrawal

14. According to art. 5 D.Lgs 185/1999, if the customer is a consumer (ie a person who buys goods for purposes not related to his professional activity, or does not indicate the purchase order form at www.gorigioielli.com a reference to VAT), has the right to terminate the purchase contract for any reason, without explanation and without penalty, except as described in paragraph 17 below

15. To exercise this right, the customer must send GORI GIOIELLI a communication to that effect, within 10 working days from the date of receipt of goods. This communication must contain the order number and invoice number/date and, in case of partial withdrawal, the article code(s) of the products for which you intend to exercise the right of withdrawal. 16. The right of withdrawal is still subject to the following conditions: - the right applies to product purchased in its entirety, it is not possible to exercise withdrawal only on part of the product purchased; - the purchased goods must remain intact, or returned intact in its original packaging complete in all its parts (any documentation and accessory equipment: manuals, etc. ...); - the customer must affix the original packaging to the goods.The Customer must affix in a visible position on the original packaging and on the delivery note the RMA number (return authorisation code) provided in the instructions sent by e-mail by the Customer Service of gorigioielli.com; in all cases the affixing of labels or adhesive tape directly on the product must be avoided. - in accordance with the law, shipping costs related to the return of the goods are charged to the customer, will not be reimbursed the cost of delivery to the customer and any other costs highlighted at the time of the order; - the shipment, until the certificate of receipt in our warehouse, is under the responsibility of the customer; - in case of damage to the goods during transport, GORI GIOIELLI will notify the customer (within 5 working days of receipt of goods in their stores), to enable him to file a timely complaint against the carrier of his choice and obtain reimbursement of the value of the property (if insured); in this case, the product will be made available to the customer for its return, simultaneously canceling the request for withdrawal; - GORI GIOIELLI is not responsible in any way for damage or theft / loss of goods returned by uninsured shipments; - upon arrival at the warehouse, the product will be examined to assess any damage or tampering not resulting from transport. If the packaging and / or the original packaging are damaged, GORI GIOIELLI will deduct from the refund due to a percentage, but no more than 50% of the same, as a contribution to the costs of restoration

17. Notwithstanding any repair costs for damage to the original packaging, GORI JEWELLERY will refund the customer the amount already paid for the purchase of goods, within 30 days of its return, by transferring the amount by bank transfer. It will be the Customer's responsibility to promptly provide, by e-mail at [email protected] , the bank details on which to obtain the refund (IBAN CODE). In the case in which the holder of the invoice object of the exercise of Withdrawal did not have its own bank details, can provide those of a family member or acquaintance making explicit mention of authorization to GORI GIOIELLI to credit the amount on those bank details

18.The right of withdrawal is totally lost, for lack of the essential condition of integrity of the good (packaging and / or its contents), in cases where GORI GOIELLI finds: - the lack of the original internal packaging; - the absence of integral elements of the product (accessories, manuals, parts, ...); - the damage of the product for causes different from its transport. In case of forfeiture of the right of withdrawal, GORI GIOIELLI will return to sender the property purchased by charging the same shipping costs


19.All products sold by gorigioielli.com are covered by the conventional warranty of the manufacturer (of different duration depending on the product) and by the warranty of 24 months for defects of conformity, according to D.Lgs. 24/02. In order to benefit from the assistance under warranty, the Customer must keep the invoice that the Customer will receive together with the product

20. The warranty of 24 months pursuant to Legislative Decree 24/02 applies to products that present a lack of conformity, provided that the product is used properly, in accordance with its intended use. This warranty is reserved for the private consumer (a person who buys goods for purposes not related to his professional activity, or making a purchase without indicating in the order form a reference to VAT). In case of lack of conformity, GORI GIOIELLI provides, at no cost to the customer, the restoration of conformity of the product by repair / replacement or reduction of the price, until the termination of the contract. If the defect does not result in a lack of conformity pursuant to Legislative Decree 24/02, the customer will be charged for any costs of verification and restoration and transportation costs

21. In the event that, for whatever reason, is unable to make its customer a product under warranty (restored or replaced), GORI GIOIELLI will proceed at its own discretion to refund the full amount paid or its replacement with a product of equal or superior characteristics

22. No damage can be requested to GORI GIOIELLI for any delays in repairs or replacements

23. In cases where the application of guarantees provides for the return of the product, the goods must be returned by the customer in its original packaging, complete in all its parts (including any documentation and accessories: eg manuals, etc. ...)


24. Pursuant to the provisions of the T.U. Privacy D.Lgs. n.196/03 we inform you that the processing of your data (which will be done by computer) has the sole purpose of proceeding to the execution of the contract. For the execution of the contract, we will transmit the data to the company that manages the relationship with the carrier, solely in order to ensure the execution of all phases of the sales and shipping process. The provision of data is compulsory as it is necessary for the purpose of executing the sales contract. In no case will we use the information in our possession for purposes other than those mentioned above, nor will we communicate it to external companies. 26. Any possible complaint must be addressed to GORI GIOIELLI, applicable law and competent court of law

27. The contract of sale between the Customer and GORI GIOIELLI at www.gorigioielli.com is understood to be concluded in Italy and governed by Italian law. For the solution of civil and criminal disputes on the interpretation and/or execution deriving from the conclusion of this contract of sale at a distance, as well as if the Customer is a consumer, the territorial jurisdiction is always that of the Court of Rome.
